Agreement to Terms

By accessing or using FeedSync's product feed automation platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

Description of Service

FeedSync provides an AI-powered product feed automation platform that enables businesses to create, optimize, and distribute product feeds across multiple channels, marketplaces, and AI platforms (including but not limited to ChatGPT, Perplexity, Gemini, and other conversational AI assistants). Our Service includes feed management, AI enrichment, real-time synchronization, analytics capabilities, and agentic commerce enablement.

Account Registration

To use our Service, you must:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

Acceptable Use

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service

Your Content

You retain all rights to the product data and content you upload to our Service ("Your Content"). By uploading Your Content, you grant us a limited license to use, process, and display Your Content solely to provide the Service to you. You represent that you have all necessary rights to Your Content and that it does not violate any third-party rights.

Intellectual Property

The Service, including all software, algorithms, designs, and content (excluding Your Content), is owned by FeedSync and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without our express written permission.

Payment Terms

If you subscribe to a paid plan:

  • You agree to pay all fees according to your selected plan
  • Fees are billed in advance on a recurring basis
  • All fees are non-refundable except as required by law
  • We may change our fees with 30 days' notice
  • You authorize us to charge your payment method automatically

Service Level and Availability

While we strive to provide reliable service, we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any aspect of the Service at any time. We are not liable for any modification, suspension, or discontinuation of the Service.

Termination

You may terminate your account at any time through your account settings. We may suspend or terminate your access to the Service if you violate these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Third-Party Platforms and AI Services

FeedSync facilitates the distribution of your product data to third-party platforms, marketplaces, and AI services. You acknowledge and agree that:

  • FeedSync acts solely as a data optimization and distribution service
  • We do not control how third-party platforms (including AI platforms like ChatGPT, Perplexity, or Gemini) use, display, or recommend your products
  • Each third-party platform has its own terms of service, policies, and algorithms that govern product visibility and recommendations
  • FeedSync is not responsible for the actions, decisions, or recommendations made by AI platforms or their algorithms
  • We do not guarantee product visibility, placement, or sales on any third-party platform
  • You are responsible for ensuring your products comply with each platform's policies and requirements
  • FeedSync's responsibility ends once product data is successfully transmitted to the third-party platform
  • We are not liable for any changes, interruptions, or discontinuation of third-party platform services

AI-Generated Content

Our Service uses artificial intelligence to enhance and optimize product content. You acknowledge that:

  • AI-generated content is provided as a suggestion and should be reviewed before use
  • You are responsible for reviewing and approving all AI-generated content
  • FeedSync is not liable for inaccuracies in AI-generated content
  • You retain final editorial control over all product information
  • AI-generated content may not always be perfect and should be verified for accuracy

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FEEDSYNC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. THIS INCLUDES BUT IS NOT LIMITED TO DAMAGES ARISING FROM THIRD-PARTY PLATFORM DECISIONS, AI PLATFORM RECOMMENDATIONS, PRODUCT VISIBILITY, OR SALES PERFORMANCE ON ANY CHANNEL.

Indemnification

You agree to indemnify and hold harmless FeedSync from any claims, damages, losses, liabilities, and expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
